Welcome to Moonbeat AI. By downloading, installing, or using our application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

By accessing or using Moonbeat AI, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the app.

We may modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the modified Terms.

Moonbeat AI is a dream journaling application that allows you to:

• Record and transcribe dreams using voice input
• Analyze dream content using on-device AI
• Generate artistic video visualizations of your dreams
• Store and organize your dream journal in the cloud

To use Moonbeat AI, you must sign in using Sign in with Apple. You agree to:

• Provide accurate information
• Maintain the security of your Apple ID
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use

4.1 Free Tier

Free users receive 3 video generation credits. Once used, additional credits require a Pro subscription.

4.2 Moonbeat AI Pro Subscription

Pro subscribers receive 30 video generations per month and access to premium features including AI dream interpretation and full emotional analytics. Subscription options include:

• Monthly: 30 videos per month, billed monthly, auto-renews
• Yearly: 30 videos per month, billed annually, auto-renews
• Lifetime: 30 videos per month, one-time purchase, no expiration

Video quotas reset on the first of each calendar month.

4.4 Managing Subscriptions

You can manage or cancel your subscription through your Apple ID account settings or the Customer Center within the app. Cancellation takes effect at the end of the current billing period.

4.5 Refunds

Refunds are handled by Apple according to their refund policy. We cannot process refunds directly.

5.1 Your Content

You retain ownership of all content you create, including dream recordings, transcriptions, and any text you enter. By using our service, you grant us a limited license to store, process, and display your content solely to provide the service to you.

5.2 Content Restrictions

You agree not to use the service to:

• Upload illegal, harmful, or offensive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to access other users' data
• Interfere with or disrupt the service
• Use automated systems to access the service

6.1 Video Generation

Videos are generated using AI technology. You understand that:

• AI outputs may not perfectly match your expectations
• Generation quality may vary
• We do not guarantee specific results

6.2 Ownership of Generated Content

You own the videos generated from your dream descriptions, subject to the following:

• Videos are for personal, non-commercial use
• We retain the right to use anonymized generation data to improve our services
• Third-party AI providers may have additional terms

The Moonbeat AI app, including its design, features, and code, is owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the app
• Reverse engineer or decompile the app
• Use our trademarks without permission
• Create derivative works based on the app

Not Medical Advice: Dream analysis provided by Moonbeat AI is for entertainment purposes only and should not be considered psychological, medical, or professional advice.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or content
• Loss of profits or revenue
• Service interruptions
• Reliance on AI-generated content or analysis

Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

We may suspend or terminate your access to the service at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• At our sole discretion with reasonable notice

Upon termination, your right to use the service ceases immediately. You may request deletion of your data.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.

• Entire Agreement: These Terms constitute the entire agreement between you and us.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms. We may assign them freely.

These additional terms apply to use of the app from the Apple App Store:

• These Terms are between you and Moonbeat AI, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for any claims related to the app
• Apple is a third-party beneficiary of these Terms
